1. AGREEMENT TO TERMS
These Terms and Conditions ("Agreement") constitute a legally binding agreement between you ("Client," "you," or "your") and Apex Credit Pros ("Company," "we," "us," or "our"), a credit repair organization operating in the State of New Jersey.
By signing our service agreement or using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
2. SERVICES PROVIDED
Apex Credit Pros provides credit repair and credit consultation services, including but not limited to:
Credit report analysis and review
Dispute preparation and submission to credit bureaus
Communication with creditors and credit reporting agencies
Credit education and financial guidance
Monitoring of credit repair progress
Identity theft support and affidavit assistance
We do NOT:
Guarantee specific credit score increases
Promise removal of accurate, verifiable information
Provide legal advice (consult an attorney for legal matters)
Offer loans, credit, or debt consolidation services
3. YOUR RIGHTS UNDER FEDERAL AND STATE LAW
Credit Repair Organizations Act (CROA)
Under the Credit Repair Organizations Act (15 U.S.C. ยง 1679 et seq.), you have the following rights:
A. Right to Cancel
You may cancel this contract without penalty or obligation at any time before midnight of the 3rd business day after the date you signed the contract.
To cancel, send a written notice to our address or email provided below.
B. Prohibited Practices We cannot:
Charge you before services are fully performed
Make false or misleading statements
Advise you to make false statements to credit bureaus
Advise you to alter your identification to prevent display of your credit record
C. Your Credit Report
You have the right to dispute inaccurate information directly with credit bureaus yourself at no cost.
You may obtain a free credit report annually from each credit bureau at www.annualcreditreport.com.
New Jersey Consumer Fraud Act
Under New Jersey law (N.J.S.A. 56:8-1 et seq.), you are protected against deceptive business practices. We comply with all state and federal consumer protection laws.
4. CLIENT RESPONSIBILITIES
You agree to:
Provide accurate and complete information
Respond promptly to our requests for documentation
Review your credit reports and notify us of any changes
Refrain from disputing items on your own while we are working on your case
Notify us immediately of any correspondence from credit bureaus or creditors
Maintain payment obligations as outlined in your service agreement
Not engage in fraudulent activity or misrepresentation
Failure to comply may result in delays or termination of services.
5. FEES AND PAYMENT TERMS
Service Fees:
Initial Setup Fee: $499 (one-time, non-refundable after 3-day cancellation period)
Payment is due on the NEXT BUSINESS DAY AFTER WORK IS INITIATED
Payment Methods:
We accept credit/debit cards, ACH transfers, and other payment methods as specified in your service agreement.
Non-Payment:
Late payments may result in suspension of services
Accounts 30+ days past due may be terminated
Returned payments incur a $35 fee
Refund Policy:
3-Day Cancellation Period: Full refund of any fees paid
After 3 Days: Monthly fees are non-refundable once services for that month have commenced
No refunds for work already performed
6. NO GUARANTEES OR WARRANTIES
We make NO guarantees regarding:
Specific credit score increases
Removal of any particular item from your credit report
Timeline for results
Approval for credit, loans, or mortgages
Results vary based on:
Individual credit history
Accuracy of disputed items
Credit bureau responses
Creditor cooperation
Your compliance with our instructions
We will work diligently on your behalf, but cannot control third-party actions or decisions.
7. TERM AND TERMINATION
Contract Term:
This agreement continues on a month-to-month basis until:
All disputed items are resolved, OR
You cancel services, OR
We terminate for cause
Client Cancellation:
Within 3 Business Days: Cancel without penalty (full refund)
After 3 Days: Provide written notice; you remain responsible for current month's fees
Company Termination:
We reserve the right to terminate services if:
You fail to pay fees when due
You provide false or misleading information
You engage in prohibited conduct
You fail to cooperate or respond to our requests
Continuing services would violate laws or regulations
8. TIMELINE AND PROCESS
Typical Timeline:
Credit bureau investigations: 30-45 days per round
Most cases require 3-6 months for optimal results
Complex cases may take 6-12 months
Our Process:
1. Initial credit report review and analysis
2. Identify inaccurate, unverifiable, or outdated items
3. Prepare and submit disputes to credit bureaus
4. Monitor responses and follow up as needed
5. Provide monthly progress updates
6. Escalate disputes when necessary
Note: Timelines depend on credit bureau response times and are beyond our control.
9. PRIVACY AND CONFIDENTIALITY
Your Information:
We collect and maintain:
Personal identification information
Credit reports and scores
Financial information
Communication records
How We Use Your Information:
To provide credit repair services
To communicate with credit bureaus and creditors on your behalf
To comply with legal obligations
To improve our services
Data Protection:
We use industry-standard security measures
We do not sell or share your information with third parties (except as required to provide services)
We comply with all applicable privacy laws

10. COMMUNICATIONS
Consent to Contact:
By agreeing to these terms, you consent to receive:
Email communications
Text messages (SMS)
Phone calls
Postal mail
Related to your account, services, and payment obligations.
Opt-Out:
You may opt out of marketing communications but cannot opt out of service-related communications.
11. DISPUTE RESOLUTION
Governing Law:
This Agreement is governed by the laws of the State of New Jersey and applicable federal law.
Arbitration Agreement:
Any dispute arising from this Agreement shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except:
You may pursue claims in small claims court
Either party may seek injunctive relief in court
By agreeing to arbitration, you waive your right to a jury trial.
Class Action Waiver:
You agree to resolve disputes individually and waive the right to participate in class action lawsuits.
12. LIMITATIONS OF LIABILITY
To the Maximum Extent Permitted by Law:
We are NOT liable for:
Indirect, incidental, or consequential damages
Lost profits or business opportunities
Credit denials or loan rejections
Delays caused by third parties (credit bureaus, creditors)
Actions or inactions of credit bureaus or furnishers
Our Total Liability is Limited to: The total amount of fees you paid to us in the 6 months preceding the claim.
13. INDEMNIFICATION
You agree to indemnify and hold harmless Apex Credit Pros, its owners, employees, and agents from any claims, damages, or expenses (including attorney fees) arising from:
Your breach of this Agreement
Your violation of any law or regulation
Inaccurate or false information you provide
Your unauthorized use of our services
14. COMPLIANCE WITH LAWS
Federal Compliance:
Credit Repair Organizations Act (CROA)
Fair Credit Reporting Act (FCRA)
Fair Debt Collection Practices Act (FDCPA)
Gramm-Leach-Bliley Act (GLBA)
Telephone Consumer Protection Act (TCPA)
State Compliance:
New Jersey Consumer Fraud Act
New Jersey Credit Repair Services Act (if applicable)
All applicable state consumer protection laws
15. MISCELLANEOUS PROVISIONS
Entire Agreement:
This Agreement, along with your signed service agreement, constitutes the entire agreement between you and Apex Credit Pros.
Amendments:
We reserve the right to modify these Terms at any time. Material changes will be communicated via email 30 days before taking effect.
Severability:
If any provision is found unenforceable, the remaining provisions remain in full effect.
No Waiver:
Our failure to enforce any provision does not waive our right to enforce it later.
Assignment:
You may not assign this Agreement. We may assign it with notice to you.
Force Majeure:
We are not liable for delays or failures due to circumstances beyond our reasonable control.

17. ACKNOWLEDGMENT AND ACCEPTANCE
By signing the service agreement or using our services, you acknowledge that:

You have been advised you can dispute credit report errors yourself for free

You agree to the arbitration and class action waiver provisions

18. CONSUMER NOTICE (REQUIRED BY LAW)
IMPORTANT NOTICE:
"You may cancel this contract, without penalty or obligation, at any time before midnight of the 3rd business day after the date on which you signed the contract."
"You have the right to dispute inaccurate information in your credit report by contacting the credit bureau directly, at no charge to you."
